According to Vehicle Code section 23109, it is unlawful to engage in a speed contest, or to aid or abet a contest. A speed contest is defined as a "motor vehicle race against another vehicle, clock, or other timing device."
Similarly, it is unlawful to engage in an exhibition of speed on a highway. Although there is no legal definition of "exhibition of speed", courts have found sufficient evidence in the following common example: An individual accelerated to 40 miles per hour in less than a block. His tires "peeled-off". After making a stop and right turn on a highway, he again "lost traction".
The punishment for speed contest or exhibition of speed is incarceration in the county jail for 24 hours to 90 days. Further, a person's driver's license can be suspended for 90 days to 6 months. A police officer is also authorized to immediately arrest an individual and impound his car, at the owner's expense, for 1 to 30 days.
