What is sexual battery?
Sexual battery is described under Section 243.4 of the California Penal Code. Per this law, sexual battery consists of the touching of another's intimate body parts to obtain sexual gratification or arousal or to abuse the victim. The touching of the victim is against his or her will or without consent. Depending on the circumstances, this offense may be charged as a misdemeanor or felony.
Where the alleged victim has been unlawfully restrained, was institutionalized, seriously disabled, or medically incapacitated, was unconscious at the time of the offense, or was fraudulently under the impression that the physical contact was for professional purposes (as in medical or dental situations), this offense is generally charged as a felony. In the case of unlawful restraint, the victim may have been restrained by either the person committing the offense or by an accomplice.
A misdemeanor sexual battery charge is punishable by up to one year in a county jail with fines of up to $2,000. If the victim was an employee, the fine may be as high as $3,000. In the case of felony sexual battery charges, a conviction carries penalties of up to three years in a state prison and fines that range up to $10,000.
