What constitutes stalking?
Whether stalking is charged as a misdemeanor or felony can depend on your criminal history and the details of your particular case. Misdemeanor stalking is punishable by up to a year in jail and/or up to $1,000 in fines while a felony conviction carries up to three years in prison.
- California Penal Code section 646.9 defines Stalking as:
- Willing and malicious following or harassing someone
- Making a credible verbal or physical threat
- Instilling fear in the victim by means of intimidation or threats
If the alleged stalker violated a valid restraining order, they can face up to four years in prison. Other punishments can include having to complete months of anger management or similar counseling, years of probation and in some cases, registration as a sex-offender.
